Terms of Service

1. Provider and agreement

The provider is Taaly B.V., registered in the Netherlands, KvK 90383257, Padangstraat 25H, 1094 AN Amsterdam, Netherlands. Contact: info@hiddenintel.ai. HiddenIntel and HiddenIntel AI refer to this service. An account holder acting for an organisation must be authorised to bind it and must be at least 18.

An individually agreed order takes precedence over these Terms for commercial matters. A signed data-processing agreement takes precedence for processing customer personal data. These Terms and our Privacy Policy are available to read, save and print before an agreement. Nothing here removes mandatory consumer or data-protection rights.

2. What the service does

HiddenIntel supports study design, AI-moderated voice interviews, transcripts, optional recordings and AI-assisted research analysis. Features, supported languages, models, limits and third-party services depend on the chosen plan and configuration. A staging, preview or beta environment is for evaluation; do not use it as your only copy of important research or as an assumed production service.

We will exercise reasonable skill and care. We do not guarantee uninterrupted availability, a particular research result, correct transcription, accurate AI output, or compatibility with every device. Any uptime commitment, dedicated region, support response time or recovery commitment must be expressly agreed.

3. Accounts and secure use

Keep account and invitation access secure, provide accurate account information, and notify us promptly of suspected misuse. You are responsible for people you authorise to use your workspace and for the lawfulness of content you submit. Do not share administrator keys with participants or publish private interview results without authority.

Do not bypass access or usage limits, probe other users’ data, introduce malicious code, interfere with service operation, impersonate others, or use the service unlawfully. Proportionate authorised security research must be coordinated with us.

4. Researcher and participant responsibilities

The study organiser must identify itself, explain the purpose and lawful basis, provide a study-specific privacy notice and retention period, obtain any required consent or ethics approval, and honour participant rights. Do not describe named or linkable interviews as anonymous. Do not upload unnecessary sensitive information or conduct research involving minors, special-category data or high-risk decisions without our prior written agreement and suitable safeguards.

Participation is voluntary. Participants may skip questions or end a conversation. The microphone permission enables live audio processing and transcription; stored recording is a separate choice. The organiser must not pressure people to enable recording or treat this platform’s consent screen as a substitute for its own legal obligations. A request to withdraw consent should be directed to the organiser; Taaly will assist within its role.

AI suggestions and summaries require human review. Do not rely on them for medical, legal or financial advice or as the sole basis for decisions affecting a person’s rights, access or opportunities. Verify quotations and conclusions against the saved source material.

5. Content and intellectual property

You retain your rights in studies, participant content and other material you lawfully provide. You grant Taaly a limited right to host, process, transmit and display that material only to deliver, secure and support the agreed service and comply with law, including use of necessary contracted service providers. This is not a transfer of ownership or a general model-training licence.

Taaly and its licensors retain rights in the platform, software, branding and documentation. Subject to these Terms, you may use the service for your agreed purposes. You may use outputs to the extent permitted by law and third-party rights; outputs may be similar to those generated for others, and exclusive intellectual-property rights in AI output are not guaranteed. Do not present unverified generated material as an established research finding.

6. Personal data and confidentiality

Our Privacy Policy describes Taaly-controlled processing. For customer-controlled research, the customer normally acts as controller and Taaly as processor. Before processing personal data for a customer study, the parties must put an appropriate GDPR Article 28 data-processing agreement in place, covering instructions, confidentiality, security, subprocessors, international transfers, rights assistance, incident assistance, deletion or return, and audit information. These Terms alone do not replace that agreement. Request it at info@hiddenintel.ai.

Each party must protect the other’s non-public business information and disclose it only to people and service providers who need it for the agreement and are appropriately bound, or where legally required. These duties do not cover information already public without breach, lawfully received independently, independently developed, or required to be disclosed by law. Personal data remains subject to applicable data-protection law.

7. Third-party services

Features can depend on Cloudflare, Google/Firebase, Deepgram, ElevenLabs, Microsoft Azure and, where enabled, Claude through Deepgram. Their availability, regions, supported models and contractual restrictions may affect the service. If you connect your own provider account, you are responsible for the necessary rights, provider terms, billing and authorised credentials. We remain responsible for our own obligations and for subprocessors as required by applicable law and the data-processing agreement.

Providers and configurations can change. We will not treat an EU database location as a promise of EU-only processing. Any required subprocessor notice, objection process or transfer protection must be addressed under the data-processing agreement before the relevant change.

8. Fees, plans and cancellation

Your first study and first completed research interview are free, without a payment method. Creating a study has no separate fee. After the free completed interview, a saved payment method and explicit payment authorisation are required for further interviews. Current standard pricing is EUR 2 per completed interview, or SAR 8 where the Saudi-riyal offer is selected in the agreed order, inclusive of applicable VAT. There is no subscription fee. An incomplete interview, preview or public demo is not billable. Each account includes one free completed research interview. After that, the account holder must set up a payment method and expressly authorise automatic payment through Stripe before further paid use. We issue a separate invoice and request collection after each completed billable interview. Currency and the VAT-inclusive unit price are shown before authorisation. Failed payments or an invoice requiring authentication can pause new interviews until resolved; completed research remains available. Account creation alone does not authorise payment. Other prices, currency, taxes and usage limits apply only where expressly agreed in an order. Creating a free account, requesting an upgrade or joining a participant interview does not itself authorise a charge. The billing screen shows the status of interview charges and provides Stripe-hosted invoices for viewing or completing payment. A processor failure may delay collection, and payment retries do not create an additional interview charge.

The payment authorisation covers the disclosed per-interview charges and does not create a subscription. Cancellation and refunds follow the agreed order and mandatory law; contact info@hiddenintel.ai if no self-service cancellation option is available. For a consumer distance contract, applicable withdrawal rights, normally 14 days, and any lawful exception must be explained at purchase; early supply does not remove those rights without the express consent and acknowledgements required by law. No term imposes an undisclosed renewal or forfeits a mandatory remedy.

9. Suspension, termination and data return

We may restrict access where reasonably necessary to address unlawful use, a material breach, unpaid agreed fees, a security risk or a legal obligation. We will explain the reason and provide a reasonable opportunity to remedy it where feasible, unless immediate action is required or notice is legally prohibited. Restrictions should be proportionate and may be reviewed by contacting us.

You may stop using the service and request account closure. Stopping paid use, deleting an account and deleting research content are distinct requests. Ask for export or return of necessary data before closure. Return, deletion and any remaining lawful retention must follow the applicable data-processing agreement and law. Archiving a study does not delete its results. Fees and remedies on termination follow the order and mandatory law; termination does not erase accrued rights.

10. Liability and remedies

Each party is responsible for loss caused by its breach or unlawful conduct under applicable law. A customer must take reasonable steps to limit avoidable loss and maintain appropriate copies of important research. We do not exclude liability for our own intentional misconduct, deliberate recklessness, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.

For business customers only, and insofar as Dutch law permits, aggregate liability arising from the agreement in a twelve-month period is limited to the greater of EUR 1,000 or fees paid or payable for the service in that period. This cap does not restrict mandatory data-subject rights, a party’s obligations to a supervisory authority, or liability that cannot lawfully be limited. No business liability cap or exclusion applies to consumers where prohibited or unfair. Consumer conformity, repair, refund, compensation and other mandatory remedies remain available.

11. Changes and communications

We may make reasonable service or Terms changes for legal, security or operational reasons. We will provide advance notice of material contractual changes in a durable form, normally at least 30 days where feasible, explain when they take effect, and allow termination before a materially adverse change takes effect. Urgent legal or security changes may require shorter notice. We will seek fresh acceptance where required rather than treating silence as unlimited consent.

Changes do not retrospectively change an agreed charge or remove accrued rights. Notices may be sent to the account email. Send legal notices and complaints to info@hiddenintel.ai or our postal address, with enough detail to investigate. We will acknowledge and seek to resolve complaints reasonably promptly.

12. Governing law and disputes

Dutch law governs the agreement. For business customers, disputes are submitted to the competent court in Amsterdam, unless the parties agree otherwise in writing or mandatory law requires another court. Consumers retain the protection of mandatory law of their habitual residence and any right to bring proceedings in another competent court. Nothing restricts a complaint to a supervisory authority.

If a provision is invalid, the remaining provisions continue insofar as legally possible; an invalid consumer clause is not replaced in a way that removes mandatory protection. These Terms do not create a partnership or employment relationship. Any assignment must respect applicable law, confidentiality and data-protection duties.
